We as hosts of this website and the connected services are responsible for the elicitation, use, processing and passing on (in the following: “process” or “processing”) of personal data of our users in the sense of the General Data Protection Regulation (GDPR). Our service includes our website and all other subdomains, and the products Map2Fly, Map2Fly_Pro and FlySchool.

We take the security of your personal data very serious and protect your privacy and your private data. We process your personal data in accordance with the content of this privacy policy and adhere strictly to the regulations of the Data protection law of the Federal Republic of Germany, the German Telemedia Act and the data protection regulations of the European Union (in the following: “data protection legal requirements”).

In these data protection laws it is specified which of your personal data we process. We therefore kindly ask you to read the following explanation carefully.

We will obligate our employees and partners to comply with the data protection legal requirements and guidelines.

1        Processing of personalized data

1             Personal data in the sense of this data privacy policy are all information about you as a person and information that refer to you as identified or identifiable person, e.g. data of your personal or objective conditions.

In order to offer our services, for building a data protection and compliance management and for contacting, we process the following personal data which you enter as part of your registration or completion of your profile:

Full name
Email address
Company name
Address (street, house number, ZIP-code and city)
Phone number and mobile phone number
Picture of your profile

Furthermore we process data which is connected with your account regarding e.g. drones, equipment or projects to provide our services.

2             Personal data also information about your usage of our websites. In this context we process personal data as followed: information about your visits of our website (e.g. extent of transferred data, location from that you call our websites and other connection data and sources that you call. Normally this is done by using logfiles and cookies. More information about logfiles and cookies you can find in section 3.1.

3             We store your personal data as long as you use our services. We delete your personal data (see section 2.1) that you provide by signing up to our newsletter when you sign off from our newsletter. Personal data that you provide by registration or using our services (see section 2.2 and 2.3) is deleted within 90 days after you cancel our services or delete your account. Storage of your personal data longer than 90 days arises from legal regulations, e.g. legal archiving requirements of your invoices.


2        Intended use

In the following we state the use of your personal data mentioned in section 1.1.

1             Processing of your personal data after you signed up for our newsletter:

  • While signing up to our newsletter using our homepage it is necessary to enter your email address. We will process it in order to send you our newsletter, informations and notes. These notes can contain advertisement of our own products or products of our partners.

2             Map2Fly and Map2Fly_Pro

  • By using Map2Fly it can be necessary to enter your email adress. We process your email adress for validating your accounts or for providing our service of Map2Fly. This includes the complete technical necessary communication with you in case of support, questions regarding your account or for resetting your password. Furthermore, we will use your email adress to send you newsletters, information or notes. These notes can contain advertisement of our own products or products of our partners.
  • By using Map2Fly_Pro it is necessary to enter your personal data. This includes your first name and surname, your email adress and if available the name of your company. Your first name and surname we will use to display in your personal Map2Fly user profile and on your individual starting page and also for transferring to our payment provider PayOne for creating a correct invoice. We will process your email address to display in your in profile, to validate your accounts and to ensure provision of our services of Map2Fly_Pro. This includes the complete technical necessary communication with you in case of support, questions regarding your account or for resetting your password. Furthermore, we will transfer your email address to our payment provider PayOne to inform you about new invoices. Moreover, we will use your email address connected with your first name and surname to send you newsletters, informations and notes. These notes can contain advertisement of our own products or products of our partners. Your companies’ name and your postal mailing address we will also display in your account. We will also transfer this data to our payment provider PayOne for creating a correct invoice. Furthermore, we process your phone number and mobile phone number to display in your account and for contacting you to deliver you via SMS or messenger services informations and notes. These notes can contain advertisement of our own products or products of our partners. You can also store an own profile picture in your profile. Independently whether you store an own picture or not which may identify you as an individual person we will use this picture just for displaying in your profile.

3             FlySchool

  • When using FlySchool we protocol every use oft he App and every call for content. Processing this information is for internal system related and statistic reasons, for presenting different questions in a meaningful order, to prevent double questions and for showing you progress in your personal learning statistic. We process: name of the opened data, date and time of transferred data, amount of transferred data, information about successful request for data, type of web browser and requesting domain or user. Additionally, the IP-adresses of requesting users are protocolled or email adresses of logged in users are used for statistical reasons. Other personal data is just used, when you make them voluntarily e.g. by registration or inquiries.
  • If you register for FlySchool, we process the following personal data: first name, surname, email adress. This is mainly for validating your account and for providing our services of FlySchool. This includes the whole technical necessary communication with you in case of support, questions related to your account or for resetting your password. Furthermore, we process your email address related to your first name and surname send you newsletters, informations or notes. These notes can contain advertisement of our own products or products of our partners.
  • Your first name and surname we will use to display them in your personal profile and your individual starting page.
  • For providing our service of FlySchool it is necessary to have access to your mobile data. Eventually FlySchool needs full acess to your contacts, your locations or additional applications to have full access of all functions of FlySchool.

4             Contact and support

  • On our website, we use different forms to be reachable for you. These forms consist forms for general requests (contact form) but also for special support requests (support form). Your personal data transferred to us (name, surname, email adress, phone) will exclusively be used to communicate with you in the context of your requests, unless you wish to be signed in to our newsletter. Without a newsletter registration, we delete your data within 3 months, unless there are no other legal retention requirements.
  • Via the feedback function of Map2Fly or Map2Fly_Pro we do not process any personal data, because they are completely anonymized.

5             Consequences of failure to provide personal data

  • As explained above we need your personal data in order to offer you the service portfolio of the FlyNex GmbH. In case you fail to provide us with the above-mentioned personal data, you might not be able to use all services and the support of the FlyNex GmbH in its full expense. We need at least your email address to validate your accounts and for technical communication in case of requests for support, questions regarding your account or to reset your password. In case of booking chargeable services, we need at least your first name and surname, your postal mailing address and your payment information to receive payments from you and to give you a correct invoice.

6             Processing your personal data while you visit our website or our subdomains:

While visiting our website https://www.flynex.io/ or its subdomains or while being forwarded to our website or its subdomains, we use your personal data for the following purposes:

  • In order to deliver the services of the FlyNex GmbH and your chosen services
  • In order to make sure that our website is highly effective and interesting presented to you
  • In order to fulfill our obligations resulting from contracts between you and us
  • In order to communicate with you, to verify your data, to send you newsletter, information and notes
  • In order to inform you about changes of our services


3         Information about your computer, cookies and targeting

1             Each time you access our site, we lawfully process the following information about your computer on the basis of Art. 6 section 1 f GDPR: the IP address of your computer, the request of your browser and the time of this request. In addition, the status and the amount of data transferred are recorded within the scope of this request. We also collect product and version information about the browser and operating system of your computer. We also record the website from which our page was accessed. The IP address of your computer is only stored for the duration of your use of the website and is then immediately deleted or made anonymous by shortening it. The remaining data is stored for a limited period of time. We use this data for the operation of our website, in particular to detect and eliminate errors on the website, to determine the utilization of the website and to make adjustments and improvements.

2             We may also process information about your use of our website through the use of browser cookies. These are small text files which are stored on your data carrier and which store certain settings and data for exchange with our system via your browser. A cookie usually contains the name of the domain from which the cookie data was sent, information about the age of the cookie and an alphanumeric identifier. Cookies enable our systems to recognize the user’s device and to make possible presettings available immediately. As soon as a user accesses the platform, a cookie is transferred to the hard disk of the user’s computer. Cookies help us to improve our website and to offer you a better and even more customized service. They enable us to recognize your computer when you return to our website and thereby:

-              store information about your preferred activities on the website so that we can tailor our website to your individual interests. This includes, for example, advertising that corresponds to your personal interests;

-              speed up the processing of your requests.

3             The cookies we use only store the above-mentioned data about your use of the website. This is done by assigning an identification number to the cookie (“cookie ID”) rather than by assigning it to you personally. The cookie ID is not combined with your name, your IP address or similar data that would enable the cookie to be assigned to you. You can learn how to prevent the use of browser cookies in section 3.6.

4             Our website uses so-called tracking technologies (such as Google Analytics and Matomo). We use these technologies to make our website more interesting for you. This technology enables Internet users who have already been interested in our website to be addressed with advertising on the websites of our partners. The insertion of these advertising materials on the pages of our partners is based on a cookie technology and an analysis of the previous usage behaviour. This analysis is carried out under a pseudonym and no user profiles are combined with your personal data. If you do not agree to the creation of user profiles, you can object to this by sending us a message. A special opt-out cookie is then stored on your computer, which must be stored permanently. If you delete this cookie or it is automatically deleted by browser settings, you must reinstall this cookie the next time you visit our site.

5             We work with business partners such as Facebook, Google and other affiliate services who help us to make the Internet offer and the website more interesting for you; any advertising links are accordingly marked as such on the website. For this reason, cookies from these partner companies are also stored on your hard drive when you visit the website. These are cookies that automatically delete themselves after the specified time. Cookies from our partner companies also only collect data under a cookie ID that enables our advertising partners to address you with advertising that might actually be of interest to you. You can learn how to prevent the use of such cookies in section 3.6.

6             If you do not wish to use browser cookies, you can set your browser in such a way that cookies are not accepted (for instructions, see the help of your browser or the website of your browser manufacturer). Please note that in this case you may only be able to use our website to a limited extent or not at all. If you only want to accept our own cookies, but not those of our service providers and partners, you can select the setting in your browser “Block third party cookies”.

7             The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are: Browser type and browser version, operating system used, referrer URL, host name of the accessing computer, time of the server request. These data cannot be assigned to specific persons. These data are not combined with other data sources. We reserve the right to check these data subsequently if we become aware of concrete indications of an illegal use.


4        Data security / Privacy

All information that you transmit to us is stored on servers within Germany. Unfortunately, the transmission of information via the Internet is not completely secure, which is why we cannot guarantee the security of the data transmitted to our website via the Internet. However, we protect our website and other systems by technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons. In particular, your personal data is transmitted in encrypted form. We use the coding system SSL (Secure Socket Layer) or TLS (Transport Layer Security).


5        No passing on of your personalized data

We don´t pass your personal data to third parties, except for you have agreed in passing on your personal data or or we are obliged due to legal regulation and/ or official or judicial orders. This can be the provision of your personal data for reasons of prosecution, security or enforcement of intellectual property rights.


6        Privacy and third party websites

The website may contain hyperlinks to and from third-party websites. If you follow a hyperlink to one of these websites, please note that we cannot assume any responsibility or guarantee for third-party content or data protection conditions. Please check the applicable privacy policy before submitting any personal information to these websites. We also use the following services to optimize our processes. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

1          Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. We use Google Analytics only with activated IP anonymization. This means, your IP address within EU Member States or in other member states of the European Economic Area, Google will shorten your IP address before transmitting it. The information generated by the cookie about your use of the website is generally transmitted to and stored on Google servers in the United States. Google is certified under the conditions of “EU – U.S. Privacy Shield Framework”. Furthermore FlyNex has a data processing agreement with Google in which Google is obliged to protect the data of our users and process them according to the privacy policy and not to pass them along to third parties.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. 1.2 Refusal of the collection of data

Webtracking:    

This prevents the collection of your data on future visits to this website. This disables both Facebook Pixel and Google Analytics. You can reactivate the recording of your data by pressing the button again. The activation / deactivation is only valid for the currently used device and the used browser and must therefore be repeated on each device / browser.

1.3 Demographic characteristics

This website uses the function “demographic characteristics”. Out of this reports can be generated regarding sex, age and interests of website visitors. This data comes from interest related advertisements and visitor data from third parties. This data is not related to an individual person. You can always deactivate this function via the preferences in your Google account or by deactivating the collection of data (see section 1.2 “Refusal of collection of data”).

2             Google AdWords

We use the online advertising program “Google AdWords” and conversion tracking as part of Google AdWords. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The conversion tracking cookie is set when a user clicks on an ad served by Google. Cookies are small text files that are stored on your computer system. These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page. Each Google AdWords customer receives a different cookie. Cookies cannot therefore be traced through the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, you will not receive any information that personally identifies users. 3             Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our websites. Provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). With reCAPTCHA it should be checked whether the data entry on our websites (e.g. in a contact form) is done by a human being or by an automated program. For this reCAPTCHA analyzes the behavior of the web site visitor on the basis different characteristics. This analysis starts automatically as soon as the website visitor enters the website. For analysis reCAPTCHA evaluates various information (e.g. IP address, time the website visitor stays on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google. The reCAPTCHA analyses run completely in the background. Visitors to the website are not informed that an analysis is taking place. Data processing is carried out on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting his website offers against abusive automated spying and SPAM. 4             Google Tag Manager

This website uses the Google Tag Manager. This service allows website tags to be managed through an interface. The Google Tool Manager only implements tags. This means that no cookies are used, and no personal data is collected. The Google Tool Manager triggers other tags, which in turn collect data if necessary. However, the Google Tag Manager does not access this data. 5             Google Web Fonts

This website uses external fonts, Google fonts. Google fonts is a service from Google Inc. By using web fonts it is possible to provide to you optimal presentation of our website, independent what fonts you have installed on your device. Implementation of this web fonts occurs via server request, normally a Google server in the U.S.A. Hereby the information will be transmitted what of our pages you visited. Furthermore your IP address will be stored by Google. Using web fonts underlies paragraph 6 number 1 f GDPR because we have a legimitate interest to optimally present and transmit our web appearance. 6             Facebook-Plugins (Like Button and Facebook Pixel)

Our websites contain plugins to the external social network, Facebook. This external social network is exclusively operated by Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA. Facebook plugins are made clearly through the Facebook logo or the add-on “like button” on our pages. When you visit our websites via this plugin will be established a direct connection between your browser and Facebook servers. Thereby Facebook gets information, that you with your IP address visited our pages. The data collected in this way is anonymous to us, i.e. we do not see the personal data of individual users. Webtracking:    

Future collection of your data through visiting this website will be prevented. Facebook Pixel and Google Analytics will be deactivated. Our websites contain plugins of the website YouTube operated by Google. YouTube is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

When you visit our websites that contain a YouTube Plugin, a direct connection between your browser and YouTube servers will be established. Thereby YouTube gets information, that you with your IP address visited our pages. For our online marketing activities, we use HubSpot. HubSpot is an integrated software solution with that we can cover different aspects of our online marketing. This includes email marketing (newsletter and automated mailings e.g. for providing downloads), social media publishing and reporting, reporting (e.g. sources of traffic or accesses), contact management (e.g. user segmentation and customer relationship management), landing pages and contact forms. Our registration service allows users of our website to get more information about or company, to download content and to provide your contact information, especially your surname, first name, email address, postal address and phone number and more demographic information. This information and the content of our pages is saved on servers from HubSpot. They can be used to interact with visitors from our websites and to get the information what kind of services are interesting for them. All information underlies this privacy policy. We use this information just to optimize our marketing instruments. HubSpot is a software company from the U.S.A. with an office in Ireland. HubSpot is certified under „EU – U.S. Privacy Shield Frameworks“ and underlies TRUSTe ’s Privacy Seal and „U.S. – Swiss Safe Harbor“ Framework. Also, we use HubSpot on basis of EU standard contractual clauses. Furthermore we have a „Data-Processing-Agreement“ with HubSpot. This is a contract in which HubSpot is bound to protect the data of our users, process them appropriate to their privacy policy in our order and not to give them away to third parties.

Our services Map2Fly und Map2Fly_Pro use Mapbox Tiles to display interactive maps. These Mapbox tiles API is a service from Mapbox Inc., 1509 16th St NW, Second Floor, Washington, DC 20036 (Mapbox). By using MapBox Tiles API information about the usage of our wensites including your IP address can be transmitted to the U.S.A. If you open a websitet that contains Mapbox tiles maps your browser establishes a direct connection with servers of Mapbox. The map content will be transmitted from Mapbox directly to your browser and embedded in the website. That´s why we don´t have any influence on the amount of data Mapbox collects. If you don´t want that Mapbox collects, processes or uses data about you, you can deactivate JavaScript in your browser. In this case can´t use map viewing. Further information about the amount and aim of data collection and further processing by Mapbox, your rights and possibilities for settings to protect your privacy you can find in the privacy policy of Mapbox under https://www.mapbox.com/privacy/.

There you can find that e.g. your IP address, the address of the visited website, date and time are saved. This information is according to Mapbox processed only to improve their service for diagnosis and analytics. Personal data is not distributed to third parties.

Mapbox is certified under „EU – U.S. Privacy Shield Frameworks“ and underlies „U.S. – Swiss Safe Harbor“ Framework. Furthermore we have a „Data-Processing-Agreement“ with Mapbox. Our websites contain plugins of the video service Vimeo. The functionalities are offered by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA. Our newsletters are distributed by the service MailChimp. MailChimp is offered by Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. Your email adress for receiving our newsletter as well as other data as described in this privacy policy are stored on MailChimp servers in the U.S.A. MailChimp processes this information to send and analyse newsletter in our mandate. Furthermore MailChimp can process this data to optimise ist own services e.g. technical optimisation for distributing or displaying newsletters or for economic reasons to know from which countries are receivers. MailChimp doesn´t use this information to conteact you or to sell the information to third parties. With the help of MailChimp we can analyse our newsletter campaigns. If you open an email sent by MailChimp this email contains a file (web-beacon) that establishes a connection to servers of MailChimp within the U.S.A. By this we can see whether the email was opened and which links where clicked. Furthermore technical information is processed (e.g. time of opening, IP adress, type of browser and operating system). This information can´t be related to individual users. They are used for statistical analysis of newsletter campaigns. Results of this analysis can be used to better adjust future campaigns according to recipient´s interests. If you don´t want tob e analysed by MailChimp, you have to unsubscribe from our newsletter (see chapter 7 of this privay policy). Lawfulness of already processed data stays unaffected by cancellation.

The data you gave us for receiving our newsletter are stored until you unsubscribe. In case of unsubsription your data will be deleted from our and also the servers of MailChimp. Other data (e.g. email address for account reasons) stay unaffected by this.
