We also talk about flying over private areas and what there is to consider here in terms of privacy. Both cases are punished most severely of all offenses, which is why custodial sentences can be imposed here.<\/p>\n<p>Therefore, below we clarify what you should know about no-fly zones, including areas with crowds and flying over other people&#8217;s properties. after the amendment of the law in the future in \u00a7 21h LuftVO (see <a href=\"https:\/\/www.bmvi.de\/SharedDocs\/DE\/Anlage\/Gesetze\/Gesetze-19\/entwurf-gesetz-anpassung-nationaler-regelungen-unbemannte-luftfahrzeuge.pdf?__blob=publicationFile\" target=\"_blank\" rel=\"noopener\">p. 16<\/a>) &#8211; there are certain areas in which or above flying is prohibited &#8211; so-called no-fly zones.<\/p>\n<p>For the <a href=\"https:\/\/www.flynex.io\/news\/the-new-eu-drone-regulation-part-2-operation-categories\/\" target=\"_blank\" rel=\"noopener\">operation categories<\/a> \u201eopen\u201c and \u201especific\u201c, the following areas are prohibited, and the following distances must be observed:<\/p>\n<ul>\n<li class=\"bullets\">Airfields with take-off and landing runway (up to 1000 m lateral, 5 km in the direction of approach and departure, overflight prohibited)<\/li>\n<li class=\"bullets\">Airfields without take-off and landing runway (up to 1500 m, overflight prohibited)<\/li>\n<li class=\"bullets\">Accident and emergency sites police and rescue forces (up to 100 m lateral and high)<\/li>\n<li class=\"bullets\">Military installations (up to 100 m lateral and high)<\/li>\n<li class=\"bullets\">Industrial facilities (up to 100 m lateral and high)<\/li>\n<li class=\"bullets\">Prisons (up to 100 m lateral and high)<\/li>\n<li class=\"bullets\">Constitutional institutions (up to 100 m lateral and high)<\/li>\n<li class=\"bullets\">Highways, waterways, railroad facilities (up to 100 m lateral and high)<\/li>\n<li class=\"bullets\">Nature reserves (no lateral distance, overflight prohibited)<\/li>\n<li class=\"bullets\">Residential properties (no lateral distance, overflight prohibited)<\/li>\n<li class=\"bullets\">Open-air swimming pools, bathing beaches during operating hours (no lateral distance, overflight prohibited)<\/li>\n<li class=\"bullets\">Hospitals (up to 100 m lateral and high)<\/li>\n<\/ul>\n<p>However, there are also exceptions. These apply if the operation has been expressly consented to. A flight can then occur if you have obtained permission from property owners or hospitals (such as for our <a href=\"https:\/\/www.flynex.io\/case-study-medifly\/\" target=\"_blank\" rel=\"noopener\">Medifly<\/a> project).<\/p>\n<p>If flying a drone constitutes a dangerous interference with air traffic because, for example, there is a risk of collision with an aircraft, a fine or imprisonment (6 months to 10 years) may be imposed according to \u00a7 315 StGB. Most devices already have this feature built-in. Again, for the &#8220;open&#8221; and &#8220;specific&#8221; categories, there is an explicit prohibition on flying over areas with crowds of people. In the &#8220;specific&#8221; category, there may be exceptions under certain circumstances, but these require a permit in any case.<\/p>\n<p>A real exception here is again the third operating category &#8220;certified&#8221;. Flying over crowds is permitted here if it involves special equipment designed to fly over crowds (e.g., air cabs).<\/p>\n<p>But how are crowds defined in the first place? Unfortunately, there is no official definition. Guidance from EASA attempts this <a href=\"https:\/\/lba-openuav.de\/onlinekurs\/lehrmaterial\/luftrecht-und-sicherheit\/sicherheit-datenschutz-und-versicherung\/#:~:text=Dennoch%20enthalten%20die%20Anleitungen%20einen,geratenen%20UAS%20beliebig%20ausweichen%20k%C3%B6nnen\" target=\"_blank\" rel=\"noopener\">definition<\/a>: &#8220;A crowd is when individuals are unable to move freely enough to avoid, for example, an out-of-control UAS at will.&#8221;<\/p>\n<p>Examples include:<\/p>\n<ul>\n<li class=\"bullets\">Major sporting events, cultural, religious, or political events<\/li>\n<li class=\"bullets\">Beaches or parks on sunny (busy) days<\/li>\n<li class=\"bullets\">Shopping streets during business hours<\/li>\n<li class=\"bullets\">Ski slopes<\/li>\n<\/ul>\n<\/div><div class=\"fusion-text fusion-text-9\"><p><a id=\"Flying over private areas\"><\/a><\/p>\n<\/div><div class=\"fusion-text fusion-text-10\" style=\"--awb-margin-top:-20px;\"><p>In the past, in such cases, a \u20ac500 to \u20ac1,500 fine was imposed, and often the drone was confiscated.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-4 fusion_builder_column_1_1 1_1 fusion-flex-column\" style=\"--awb-padding-top:20px;--awb-padding-right:20px;--awb-padding-bottom:10px;--awb-padding-left:20px;--awb-bg-color:rgba(36,142,197,0.2);--awb-bg-color-hover:rgba(36,142,197,0.2);--awb-bg-size:cover;--awb-box-shadow:0px 0px 5px 5px #d9d9d9;;--awb-width-large:100%;--awb-margin-top-large:0px;--awb-spacing-right-large:1.92%;--awb-margin-bottom-large:19px;--awb-spacing-left-large:1.92%;--awb-width-medium:100%;--awb-order-medium:0;--awb-spacing-right-medium:1.92%;--awb-spacing-left-medium:1.92%;--awb-width-small:100%;--awb-order-small:0;--awb-spacing-right-small:1.92%;--awb-spacing-left-small:1.92%;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div class=\"fusion-text fusion-text-11\"><p>Always try to generously avoid crowds of people so as not to provide a basis for discussion. However, it is usually less about flying than about taking photos and videos of other people.
