B. Ende Februar <a href=\"https:\/\/www.zeit.de\/news\/2021-02\/21\/drohne-verzoegert-flugbetrieb-am-frankfurter-flughafen?utm_referrer=https%3A%2F%2Fwww.google.com%2F\" target=\"_blank\" rel=\"noopener\">in Frankfurt<\/a> der Fall war. Auch sprechen wir \u00fcber das Fliegen \u00fcber privaten Bereichen und was es hier in Bezug auf die Privatsph\u00e4re zu beachten gibt. Beide F\u00e4lle werden von allen Vergehen am st\u00e4rksten geahndet, weshalb hier auch Freiheitsstrafen verh\u00e4ngt werden k\u00f6nnen.<\/p>\n<p>Daher kl\u00e4ren wir im Folgenden auf, was man \u00fcber Flugverbotszonen, einschlie\u00dflich Bereiche mit Menschenansammlungen, und das Fliegen \u00fcber fremde Grundst\u00fccke wissen sollte. nach der Gesetzesanpassung zuk\u00fcnftig in \u00a7 21h LuftVO (siehe <a href=\"https:\/\/www.bmvi.de\/SharedDocs\/DE\/Anlage\/Gesetze\/Gesetze-19\/entwurf-gesetz-anpassung-nationaler-regelungen-unbemannte-luftfahrzeuge.pdf?__blob=publicationFile\" target=\"_blank\" rel=\"noopener\">S. 16<\/a>) &#8211; , gibt es bestimmte Bereiche, in oder \u00fcber denen das Fliegen verboten ist \u2013 sogenannte No-Fly-Zonen.<\/p>\n<p>F\u00fcr die <a href=\"https:\/\/www.flynex.io\/news\/die-neue-eu-drohnenverordnung-teil-2-die-betriebskategorien\/?lang=de\" target=\"_blank\" rel=\"noopener\">Betriebskategorien<\/a> \u201eoffen\u201c und \u201espeziell\u201c sind folgende Gebiete verboten und folgende Abst\u00e4nde einzuhalten:<\/p>\n<ul>\n<li class=\"bullets\">Flugpl\u00e4tze mit Start- und Landebahn (bis 1.000 m seitlich, 5 km in An- und Abflugrichtung, \u00dcberflug verboten)<\/li>\n<li>Flugpl\u00e4tze ohne Start- und Landebahn (bis 1.500 m, \u00dcberflug verboten)<\/li>\n<li class=\"bullets\">Unfall- und Einsatzorte Polizei und Rettungskr\u00e4ften (bis 100 m seitlich und hoch)<\/li>\n<li class=\"bullets\">Milit\u00e4ranlagen (bis 100 m seitlich und hoch)<\/li>\n<li class=\"bullets\">Industrieanlagen (bis 100 m seitlich und hoch)<\/li>\n<li class=\"bullets\">Justizvollzugsanstalten (bis 100 m seitlich und hoch)<\/li>\n<li class=\"bullets\">Verfassungsorgane (bis 100 m seitlich und hoch)<\/li>\n<li class=\"bullets\">Fern- und Wasserstra\u00dfen, Bahnanlagen (bis 100 m seitlich und hoch)<\/li>\n<li class=\"bullets\">Naturschutzgebiete (kein seitlicher Abstand, \u00dcberflug verboten)<\/li>\n<li class=\"bullets\">Wohngrundst\u00fccke (kein seitlicher Abstand, \u00dcberflug verboten)<\/li>\n<li>Freib\u00e4der, Badestr\u00e4nden w\u00e4hrend der Betriebszeit (kein seitlicher Abstand, \u00dcberflug verboten)<\/li>\n<li class=\"bullets\">Krankenh\u00e4user (bis 100 m seitlich und hoch)<\/li>\n<\/ul>\n<p>Es gibt allerdings auch Ausnahmen. Diese gelten, wenn dem Betrieb ausdr\u00fccklich zugestimmt wurde. Ein Flug kann dann stattfinden, wenn Sie die Erlaubnis von Grundst\u00fccksbesitzern oder Krankenh\u00e4usern eingeholt haben (wie z. B. in unserem Projekt <a href=\"https:\/\/www.flynex.io\/case-study-medifly\/?lang=de\" target=\"_blank\" rel=\"noopener\">Medifly<\/a>).<\/p>\n<p>Wenn das Fliegen einer Drohne einen gef\u00e4hrlichen Eingriff in den Luftverkehr darstellt, da z. B. Kollisionsgefahr mit einem Flugzeug besteht, drohen laut \u00a7 315 StGB eine Geldstrafe oder eine Freiheitsstrafe (6 Monate bis 10 Jahre). Zudem kann auch mit 3 Punkten in Flensburg und der Entziehung der Fahrerlaubnis oder der Verh\u00e4ngung einer isolierten Sperre gerechnet werden.<\/p>\n<p>F\u00fcr die dritte Betriebskategorie \u201ezulassungspflichtig\u201c gilt nach \u00a7 21c LuftVO Absatz 2, dass f\u00fcr Ger\u00e4te dieser Kategorie, aufgrund ihrer technischen Komplexit\u00e4t und ihres Verwendungszwecks (z. B. Die meisten Ger\u00e4te haben diese Funktion bereits integriert. Das <a href=\"https:\/\/www.flynex.io\/technik\/city-atm-drohnen-lernen-zu-kommunizieren\/\" target=\"_blank\" rel=\"noopener\">Projekt City-ATM<\/a>, an dem auch FlyNex beteiligt ist, testet die M\u00f6glichkeit kurzfristige Flugverbotszonen, wie z. Auch hier gilt f\u00fcr die Kategorien \u201eoffen\u201c und \u201espeziell\u201c ein ausdr\u00fcckliches Verbot f\u00fcr den \u00dcberflug von Bereichen mit Menschenansammlungen. In der Kategorie \u201espeziell\u201c kann es unter Umst\u00e4nden Ausnahmen geben, die aber in jedem Fall eine Genehmigung ben\u00f6tigen.<\/p>\n<p>Eine wirkliche Ausnahme bildet hier erneut die dritte Betriebskategorie \u201ezulassungspflichtig\u201c. Das \u00dcberfliegen von Menschenansammlungen ist hier erlaubt, wenn es sich um spezielle Ger\u00e4te handelt, die so konstruiert sind, dass sie \u00fcber Menschenansammlungen fliegen k\u00f6nnen (z. B. Flugtaxis).<\/p>\n<p>Aber wie sind Menschenansammlungen \u00fcberhaupt definiert? Leider gibt es keine offizielle Definition. Anleitungen der EASA versuchen sich mit dieser <a href=\"https:\/\/lba-openuav.de\/onlinekurs\/lehrmaterial\/luftrecht-und-sicherheit\/sicherheit-datenschutz-und-versicherung\/#:~:text=Dennoch%20enthalten%20die%20Anleitungen%20einen,geratenen%20UAS%20beliebig%20ausweichen%20k%C3%B6nnen\" target=\"_blank\" rel=\"noopener\">Definition<\/a>: \u201eEine Menschenansammlung ist dann gegeben, wenn einzelne Personen sich nicht mehr so frei bewegen k\u00f6nnen, dass sie z.
